Building Near Thika Road Mall (NAIROBI) Collapses With Dozens Of People Trapped Inside

Today seems like a rather sad day for Kenya as a country as two catastrophic events have taken place. With the #Garissasiege on going, where at least a dozen people have neen confirmed dead and bodies taken to the Garissa PGH Morgue. As this is going on, a building at Roysambu near the swanky up market TRM has collapsed.
the building which was still under construction had gone up five storeys before it went down. Reports from the scen suggest there are a number of people inside the building. Below are photos of what is on the scene.

TERRORIST ATTACK IN GARISSA,KENYA

The massacre that killed 147 people and wounded scores of others at a Kenyan university lasted for hours on Thursday before the terror was over.
"It is a very sad day for Kenya," Interior Ministry Joseph Nkaissery said of the carnage at Garissa University College.
The death toll is the highest in a terror attack on Kenyan soil since the U.S. Embassy was bombed in 1998. More than 200 people died in the Nairobi blast.
A total of 147 people were killed Thursday, according to the official Twitter account of Kenya's National Disaster Operation Centre and Kenyan media reports. The agency also said 79 people were injured and 587 people were evacuated.
Four gunmen were killed, officials said.
    The Somalia-based Al-Shabaab militant group claimed responsibility for the assault.
    Awaking to terror: 'I am lucky to be alive'
    Islamist gunmen burst into the university before dawn Thursday, shooting students and taking hostages during early morning prayer services.
    At one point, the attackers cornered a building in which 360 students live, but some of the students escaped, Nkaissery said.
    Kenyan forces cleared three of four dormitories and had cornered the militants in the last one, the Interior Ministry explained.
    "This is a moment for everyone throughout the country to be vigilant as we continue to confront and defeat our enemies," Kenyan President Uhuru Kenyatta said.
    There are usually four guards at the campus gates overnight, Jackstone Kweyu, dean of students, told Kenya's Citizen TV.
    The attack was deadlier than an Al-Shabaab attack on the Westgate shopping center in Nairobi in September 2013 that left 67 people dead.

    Witness: Gunmen shot non-Muslims

    Joel Ayora, who was on the campus and witnessed the attack, said gunmen burst into a Christian service. Taking hostages from the service, they then "proceeded to the hostels, shooting anybody they came across except their fellows, the Muslims."
    The attackers separated students by religion, allowing Muslims to leave and keeping an unknown number of Christians hostage, Agence France-Presse reported.
    "We were sleeping when we heard a loud explosion that was followed by gunshots and everyone started running for safety," student Japhet Mwala told AFP.
    "There are those who were not able to leave the hostels where the gunmen headed and started firing. I am lucky to be alive because I jumped through the fence with other students."

    US President Obama’s Cousin Dies and Buried at Kisumu Cemetry At Night



    The iconic world leader’s cousin, Rukia Mboya died on Tuesday and was buried on Thursday in Kisumu. Rukia Mboya was daughter of Zeituni Onyango, Obama’s aunt.
    Rukia Mboya succumbed to acute Leukemia at Nairobi West Hospital after about one and a half years of illness. She was buried at Sunni Muslim Cemetry at 8PM.
    She leaves behind a 21 year old daughter called Hadijah Benaziz. Rukia’s mother, Zeituni Onyango also passed on and was buried in Kisumu on 6th May 2014.

    President Uhuru and William Ruto Get Down During The Beyond Zero Marathon

    It’s no doubt that Kenya got itself one of the best presidents ever, President Uhuru Kenyatta knows how to interact with both the young and old and so does his deputy William Ruto. The two took part in the just concluded beyond marathon which is the first ladies project in honor of all women. All in attendance gathered at Nyayo stadium after the marathon where they were entertained by various local celebrities.
    The two were joined by Ezekial Kemboi on the VIP section where they were caught on camera getting down to the songs being played and they seemed to be really having fun despite their ages. Sauti Sols Sura Yako is one of the presidents favorite songs and he couldn’t help himself but sing along to the tunes when it played. Here are some of the pictures of the three.

    Kenya, Tanzania hope to resolve airport row

    Tanzania and Kenya are set to find an amicable solution to allow tour vans from the former drop and pick up tourists at Nairobi’s Jomo Kenyatta International Airport (JKIA).

    The announcement was made after a closed-door meeting on Friday between the visiting Tanzania’s Natural Resources and Tourism Minister Lazaro Nyalandu and Kenya’s Tourism Cabinet Secretary Phyllis Kandie.
    “Three weeks from today, a bilateral meeting will take place; it will be comprehensive, and it will discuss all the issues that we may have bilaterally so that we can facilitate the private sector to grow tourism between the two countries,” Kandie said at a media briefing after the meeting On December 22 last year, Kenyan authorities put a ban on Tanzanian-registered vehicles from dropping off or picking up passengers at JKIA.
    This followed claims that Tanzania had continued to deny Kenyan registered vans to take tourists directly to Tanzania airports and national parks.
    “We are not competitors and if there are any issues that are outstanding between our ministries we should meet and discuss to iron out those issues.
    And that is why Mr Nyalandu has come to visit us in Kenya so that we can discuss issues of mutual benefits,” Kandie added. The CS says in the meantime, Kenya will facilitate transport to and from JKIA, indicating that it is still not ready to lift the ban for Tanzania to access the airport.
    “We have also agreed that in order not to disrupt and inconvenience tourists, Kenya will help in the transfer of tourists within those three weeks,” she said adding that this will be through partnership with local transporters.
    In March last year the two East African States reverted to their 1985 bilateral agreement as an interim measure to resolve their differences in efforts to protect the multi-million-dollar tourism industry.

    Formation of the Jubilee Alliance Party (JAP) by ruling coalition partners ( TNA and URP) has sparked off clashing opinions among key political heavyweights in the coalition.

    Bomet Governor Isaac Ruto, who doubles up as chairman of the Council of Governors (CoG) wants President Uhuru Kenyatta and Deputy President William Ruto both of whom sanctioned the formation of the new party, to resign and seek fresh mandate following the formation of the new outfit.
    “They are not supposed to promote a new political party before resigning from their current political parties and that is exactly what they are doing in Kajiado County. It is time they resign and seek fresh mandate from the electorate,” said Ruto.
    Similarly, vocal Mandera County Senator, Billow Kerrow, hit out at Jubilee coalition leaders for “setting up a new political party secretly, with the aim of winding up TNA and URP”, without the involvement of members.
    “It is disheartening to say the least, and clearly unfair for the coalition leaders to create the so-called Jubilee Alliance Party without any form of consultation with the parliamentarians or coalition party officials. How can Jubilee ignore its members and expect us to be herded into a new outfit? Is their action not the type of dictatorship that we blame the Opposition coalition for?” protested Kerrow in a statement to newsrooms.
    But National Assembly Majority Leader, Aden Duale defended the move to form JAP arguing it was a step in the right direction in preparation for the 2017 elections and that the move would unite Kenyans as well as avoid leadership vacuum in the two parties.
    Speaking at Ol Rarinyiro Secondary School in Laikipia County on Friday, Duale said they would now embark on strengthening the party at the grassroots as well as creating good party structures.
    “This is a move aimed at moving the leadership of the Jubilee alliance forward. We will no longer have party wrangles in the alliance and that is why we created this party,” he said.
    Governor Ruto expressed shock and dismay at the move: “We are shocked that our party leaders have gone out of their way and formed a new outfit contrary to the Political Parties Act and as law abiding Kenyans we will push for their resignation so that we do not set wrong culture in the country where the law is breached haphazardly.”
    “As URP leaders we are in the dark on the same and we do not know where we are as founding members of the parties which are being dissolved secretly,” said Ruto.
    He added: “We are lost as members of URP since we were not consulted and we are going to take up the matter seriously.”
    Ruto also took a swipe at the DP saying he had failed by not calling members to meetings to discuss pertinent matters and for side-stepping party structures, which should be respected.
    Unruly manner
    “This is what we have been saying all along, URP is conducting itself in an unruly manner and you can see where it is heading now,” he said.
    Responding to Ruto, Kigumo MP Jamleck Kamau pointed out to the Bomet Governor that he was reacting out of ignorance: “My brother, Governor Ruto, does not understand what is going on. I wish he first established the facts. JAP is one of Jubilee coalition’s constituent parties. There is no broken bone and he should relax.”
    The new outfit is chaired by Nelson Dzuiya and Veronica Nduati is the Secretary General. Kenyatta and Ruto’s close allies David Murathe and Caleb Kositany taking the Vice Chair and the Deputy Secretary General respectively. It has also become evident even before the new party takes off, that some party officials, especially from Rift Valley, were uncomfortable and are openly speaking against dissolution of URP.
    Kanu Secretary General Nick Salat said the party will remain independent. “We are not party to the arrangement. That is their own as for us we are only aware of our post-election agreement which is currently in place, anything else is neither here nor there, we are going to remain as Kanu,” he said.
    Key political allies of the President and his deputy have however endorsed JAP, arguing it was the best way to go in strengthening their coalition in readiness for both the 2017 and 2022 general elections.
    On Thursday members of the ruling coalition will begin a three day retreat that will go up to Sunday where the issues of the new party and mid-term review of the government performance will take centre stage. Among those who have spoken strongly in favour of JAP include Duale, Kericho Senator Charles Keter, Elgeiyo-Marakwet Senator Kipchumba Murkomen, and Nithi MP Kareke Mbiuki. Others include Laikipia Senator GG Kariuki, Governor Joshua Irungu, Jane Apollos and Kimani Ichugwa (Kikuyu), Jude Njomo (Kiambu Town) and Laikipia West MP Wachira Karani.
    URP National Deputy organising Secretary John Kangogo said: “We as the URP will however not dissolve our party. We will maintain it.”
    Major party
    Some in the coalition feel one major party may crack and create room for smaller units the way the original Forum for Restoration of Democracy (FORD) split only months after its formation in early 1990s.
    Senator Keter said the move was meant to bring harmony among the two parties and avoid diverted allegiance to the different parties.
    “We want to avoid the situation where our coalition politicians have diverted attention, the party will bring much needed harmony,” said Keter.
    Murkomen said they were putting in place legal framework that will ensure that the new party will be used as a vehicle for Jubilee in 2017, while Mbiuki said “some of us have not played any role, but we are there to support what the President and his deputy come up with. They lead and we follow, because we want to be in a one big political family.”
    Both Mbiuki and Keter noted that President Kenyatta and his deputy were the drivers of the initiative and that explains why some of the politicians were not privy to the development.
    “We gave the two the mandate to lead us whatever they say we will follow, I am a political puppy to Kenyatta and wherever he goes I will. I am his sycophant and do support any of his initiatives,” said Mbiuki.
    However, Kerrow questioned the wisdom of Jubilee leaders abrogating themselves the duty of making decisions on behalf of members: “It is clear that despite the many reforms in the political parties law, nothing has changed in the manner our political parties are managed; more like a private entity that ‘owners’ can shut down at will.”
    This action by Jubilee, he argued, would encourage every group or region, or indeed politician, to set up their own party to avoid being locked out of personal entities.
    “As a member of URP, I call upon its chairman to urgently convene a meeting of our parliamentary group and NEC to discuss this intriguing development. I am shocked that URP has agreed to this development, knowing what has happened in the recent past to the original ODM, PNU or even Ford!” protested Kerrow.

    Nairobi residents to pay more for water

    Residents of Nairobi County are set to pay more for water. This is as the Athi Water Services Board (AWSB) moves to raise water tariffs, in a move likely to raise the cost of living for most city households.

    According to a notice in the Kenya Gazette, the water services company seeks to introduce a new component in the water tariffs pricing to help raise money for infrastructure development and to improve service delivery.
    “AWSB proposes increasing block tariff structure with a built-in component of a lifeline tariff of Sh204 per month for water consumption of up to 6,000 litres per month for piped connections,” reads the notice in part.
    Low-income segment
    Water vendors will further be expected to pay an extra shilling for each 20 litre container of water they sell, a levy that will most likely be passed on to the consumers who are often from the low-income segment.
    The new tariff adjustments, which have been proposed to the Water Services Regulatory Board are expected to take effect in three years beginning this year, and running through to 2018. This is the latest proposal to increase the waterbills for Nairobi residents in less than two months, after the Nairobi City Water and Sewerage Company successfully applied to raise the water tariffs by almost 200 per cent in a review the water company said was long overdue.
    The recent proposal comes days after the launch of a Sh6.8 billion pipeline construction project by the AWSB that is expected to ensure uninterrupted water supply for Nairobi, Kiambu and Murang’a counties within the next two years.
    Water rationing
    The northern collector tunnel will see an additional 140,000 cubic metres of water per day supplied to the city going a long way in plugging a 200,000 cubic metres per day shortfall that has seen several city estates experience water rationing.
    According to AWSB Chief Executive Officer Eng Malaquen Miglo, the construction of the northern collector tunnel constitutes the first two phases of the 2012-2035 masterplan to overhaul the water infrastructure system in East Africa’s largest urban area.
    “Nairobi City alone requires $368 million (Sh33.4 billion) and an additional $343 million (Sh31.2 billion) totalling to more than Sh60 billion,” stated Eng Miglo. The Northern Collector Tunnel is being financed with support from the World Bank, Africa Development Bank and KfW Germany.

    Esther Arunga’s Husband Quincy Timberlake’s First Wife Emerges

    A woman by the name Rose Mueni has come out claiming that Quincy Timberlake had married her for ten years before he left her for Esther Arunga. In an interview with the Nairobian, she says she met Quincy in 1999 and had three children with him but in 2003 things started taking a different turn. Quincy used to travel outside the country on business trips and at one time she noticed how his trips would be longer than usual  being away from home for three months.

    Rose had no clue whatsoever of the saga that involved Quincy and Joseph Hellon and only knew about it on the day they were arrested  for running an illegal church/cult and taken to Industrial prison where she bumped into Esther Arunga. She says that she was surprised to learn of Quincy’s and Esther’s marriage but there was nothing she could do since he claimed to have fallen out of love with her and wanted to start a new life with Esther.
    The mother of three moved out of their South B home into a smaller house where things went from bad to worse, sleeping on an empty stomach and even being kicked out for lack of rent.
    She says that this affected their children in a big way who were left with numerous questions as to why their own father would abandon them, she continuous to say that she already forgave Quincy and would take him back if he ever asked for forgiveness.

    TANZANIA:President Kikwete attends inauguration ceremony of Mozambique’s President Felipe Nyusi

    President Jakaya Kikwete yesterday attended the swearing in ceremony of Mozambique new President Filipe Jacinto Nyusi of the governing Frelimo party.

    The ceremony was held at the Independence Square, in the country’s capital, Maputo. Nyusi becomes the fourth President since the country attained its independency in 1975.
    Other Tanzanian top leaders invited to attend the swearing in ceremony included former President, Benjamin Mkapa.
    The Tanzania delegation in Mozambique also includes First Lady Salma Kikwete, Deputy Minister for Foreign Affairs and International Cooperation, Mahadhi Maalim, Minister of State Vice President’s Office in Zanzibar, Mohamed Abood Mohamed and CCM Vice Chairman, Philip Mangula.
    Others are John Shibuda a Member of Parliament for Maswa West and Mtwara Regional Commissioner Halima Dendegu.
    On Tuesday, Mozambique Minister of Foreign Affairs and Cooperation Oldemiro Baloi was quoted saying that four heads of state from the Southern Africa Development Community (SADC) confirmed to attend the swearing in ceremony.
    They are from Lesotho, Namibia, Tanzania and Malawi.
    According to him, the ceremony was divided into three different categories among them the official ceremony at the President Official house, second at the Independence Square to allow more people to witness the ceremony and the third was a musical concert also at the Independence Square.

    Museveni, M7, Sevo or whatever name you decide to call him, his blatant pronunciations of independence and open disgust towards imperialism make him darling of the media and most of the general public. however his hard line stance on other issues and his grip on power make him the subject of attacks from as many corners as imaginable.
    museveniHe does have his moments like during the inauguration of President Uhuru Kenyatta. He went hard claiming his cows to be returned. Kenyans decided this was a barb to be thrown at anyone who demonstrates bovine tendencies.

    During a function held recently, a three year old boy inched forward towards the banana republic’s keader as he gave a speech and clung on to him. This was after the kid had asked in thee local dialect, “ogu ni Museveni?Rukiga for: “Is this‪Museveni‬ ?” The president burst out in laughter and responded “ego ninye” -Rukiga dialect to say, “yes it is me Museveni ”
    After the escapade, the little boy was given an envelope to carry home.

    Knut, Kuppet reveal why they opted for court deal

    Kenya: The main teachers’ unions are optimistic the outcome of pay negotiations under the arbitration of the Industrial Court because among the contentious items on the table would be the basic salary category the Government had rejected.

    TEAIt also emerged a demand that a new deal is back-dated two years would be included in a common memorandum that the two unions are required to file in court by Monday.
    Kenya National Union of Teachers’ ( Knut) and Kenya Union of Post-Primary Education Teachers’ (Kuppet) officials explained they were confident that the historic arbitration of the protracted pay dispute by the Industrial Court presents the best opportunity for a salary increase for their members. “Even if we are given Sh1 as salary increment, then it shall be fine because what the teachers wanted is a basic pay rise,” said Knut Secretary General Wilson Sossion.
    Kuppet Secretary General Akello Misori claimed it was now certain that unions would get a salary increment determined by the court. “We shall also have a Collective Bargaining Agreement (CBA) signed and deposited (with the court). This is a double score for teachers because if we stuck to the negotiation table it would be difficult to achieve all these,” Misori told members.
    The ruling by Justice Nduma Nderi on Wednesday brokered an end to the eight-day nationwide strike that paralysed learning in public schools. The Standard established the State had been planning measures to break the spirit of the strike, including pressing for Sossion’s arrest for alleged violation of court orders, and withholding January pay for teachers had the strike escalated.
    Abandoned role
    On Thursday, it also emerged that teachers would demand that any offer awarded by the court be backdated to January 2013. The teachers’ lawyer Paul Muite said the CBA was to undergo a four-year cycle, which must be respected. “In the memorandum we shall be demanding that all payments be backdated to January 2013. The CBA cycle was 2013 to 2017,” he said.
    Misori revealed the two parties disagreed on basic pay increment which led to Justice Nderi ruling the court would take over further negotiations. “The unions presented their arguments and the judge made several observations. He said TSC ( Teachers Service Commission) had abdicated its mandate and allowed salaries and allowances be determined by the Salaries and Remuneration Commission (SRC) and Government,” said Misori.
    He said teachers argued that the allowances offered were not negotiated by the unions and therefore did not have the critical input of teachers. “The teachers also argued that the Government had placed a 50-60 per cent salary increase which made teachers revise their demand from 300 to between 100 and 150 per cent,” he said.
    Misori said Justice Nderi then asked the TSC to consult and make an offer to teachers or allow the court to take the arbitration role as per the Labour Relations Act. “When TSC returned, they said they did not have the power to make an offer. So the teachers decided that the court takes over the matter. This was the best decision we have ever made as unions,” said Misori.
    Sossion noted teachers could not take another round of talks with the TSC as several attempts had failed. “We got where we are because they refused to take the talks seriously. How silly could we be to go down the same route?” he asked.
    The two officials separately spoke to The Standard with Misori saying the two unions had taken notice of the “Government propaganda machinery” and opted to unite for a common purpose. “We saw them and we knew they were not up to any good. We decided to work together to form a formidable force that would not be divided,” conceded Misori.
    It also emerged the Government wanted Sossion charged for alleged violation of court orders and teachers who participated in the strike, punished.
    Fresh details from the Wednesday court proceedings indicate TSC asked to commence contempt proceedings against Sossion for ignoring an earlier court order barring him from engaging in strike.
    A Government lawyer who was present in court argued the teachers’ employer maintained that Sossion did not have “right of audience” in the court whose orders he never honoured.
    The TSC, SRC and Labour ministry all had legal representation in court as did Knut and Kuppet.
    On Thursday, Sossion said he read mischief in the Government’s strategy and alleged there was a plan to jail him. “First they wanted to disrupt the day’s core business. They wanted to jail me so that I cease being the secretary general of Knut. That is what they did to the union’s first secretary general Joseph Kioni in 1970,” reflected Sossion.
    “After the establishment of Knut, Kioni led four successful strikes that saw teachers get maternity leave, salary increment among other benefits. He also led a strike that saw the establishment of TSC. But the Government came up with trumped up charges that he misused union dues and sent him to jail. That is how he lost his seat,” charged Sossion.
    Sossion alleged the Government was still keen to “victimise union officials” even after the court directed there would be no victimisation of those who went on strike.
    “In 2013, they commenced contempt proceedings which we appealed at the High Court. The case is still active. These people knew that a similar case would see me thrown to jail,” he said.
    He said Justice Nderi rescued the situation. “He was a sober judge. He asked the TSC to concentrate on the current matters at hand. He also set aside the parents’ case and that is how the matter was rested, moving forward.”
    A parents’ body moved to court asking for temporary orders restraining Sossion and Knut members from calling the strike.

    Tanzania bans witchdoctors over albino attacks

    Home Affairs Minister Mathias Chikawe said there would be a nationwide operation to “arrest them and take them to court” if they continued to work.
    Albino people, who lack pigment in their skin, have faced attacks for their body parts, which witchdoctors believe bring good luck and wealth.
    The Tanzanian Albinism Society (TAS) has welcomed the ban.
    “If we and the government come together and show strength as one and speak as one, we can deal with the problem head-on,” the society’s chairman, Ernest Njamakimaya, said.
    “I believe this way we can get rid of these incidents once and for all.”
    Evidence mishandled’
    More than 33,000 people in Tanzania are believed to have albinism.
    Seventy have been killed in the past three years but only 10 people have been convicted of murder.
    Mr Chikawe said action to find and prosecute witchdoctors would begin in two weeks’ time in the northern areas of Mwanza, Geita, Shinyanga, Simiyu and Tabora, where most of the attacks have taken place.
    The ban has emerged from the work of a special joint task force between police and the TAS.
    The task force’s work will now entail reviewing previous cases of albino attacks for new evidence and conducting further research on the motive of attackers.
    Correspondents say some previous cases against alleged attackers have collapsed over the loss, mishandling or mislabelling of evidence.
    Mr Chikawe acknowledged that further training of police was required.
    The United Nations recently condemned the abduction of a four-year-old albino girl in north-west Tanzania.

    Kenya:Court stops teachers’ strike and takes over negotiations

    NAIROBI: The eight-day strike that shutdown learning in public schools has ended after the Industrial Court took over the pay negotiations and ordered teachers to return to class from Monday next week.

    The teachers’ unions did not get the increase in basic salary for their over288,000 members, they were demanding after the Teachers Service Commission TSC) refused to budge.
    The announcement followed a nine-hour discussion presided over by Justice Nduma Nderi and involving the Kenya National Union of Teachers (Knut),Kenya Union of Post Primary Education Teachers(Kuppet), TSC, Salaries and Remuneration Commission (SRC)and the Ministry of Labour.
    Knut Secretary General Wilson Sossion Wednesday asked teachers to resume classes on Monday and await the court’s arbitration.
    Justice Nderi reached the compromise decision after the Government and unions failed to break the deadlock that arose after the State rejected an increment on basic salary, and instead offered Sh9.3 billion in allowances that unions spurned.
    It will now be up to the Industrial Court to determine how much the over 288,000 teachers will take home as increment on their basic pay.
    But it is not clear whether the Sh9.3 billion allowances the Government offered them will still be on the table although all parties backed the directive to call off the strike.
    The proceedings were held behind closed doors before Justice Nderi delivered his ruling.
    In his ruling, Justice Nderi directed that no teacher or union official should be victimised for the just-ended strike.
    “After day-long deliberations, the parties have agreed to have the economic dispute handled by the Industrial Court. It is the court’s direction that TSC should not victimise any teacher or union official for participating in the strike. All teachers should therefore resume duty on Monday, pending the hearing and determination of the dispute,” Justice Nderi ruled
    He directed Knut and Kuppet to file before the court their submissions in a common memorandum by Monday whileTSC was given up to January 26 to file its response.
    SRC was directed to file its submissions on the matter 10 days after TSC files its response.
    This means that the fate of teachers’ salary demand shall be known sometime next month.
    Justice Nderi told Knut and Kuppet to call off the strike to give the court time to adjudicate the matter, saying TSCshould not withhold salaries of teachers.
    Sossion and Kuppet Secretary General Akello Misori lauded the court for agreeing to take over the decade-long dispute.
    “This is an historic day for us as a union for the Judiciary to take over the salary dispute. It is going to mark the end of the confusion and pave way for a clear picture of the teachers’ demands. We are confident that in this process, the court’s adjudication will help solve the dispute where the employer has failed on several occasions,” Sossion said.
    “We have agreed to table all the proposals by the National Advisory Council and we shall be meeting on Friday to chart the way forward,” he added.
    “I urge teachers to be patient and give the Industrial Court time to deliberate over the matter. We are optimistic that the outcome will be in the best interest of teachers since we cannot be perennial strikers for ever,” Misori said.
    Sossion termed the court session as “tough and good for us but rough on TSC”.
    “We have submitted to the court since we are law-abiding citizens and this is because we have confidence that the court will find a lasting solution to what has over the years been a tug of war between the union and the teachers’ employer,” said Sossion.
    He said two options were presented to resolve the strike stalemate.
    “The judge asked TSC to table a salary offer or go back to the negotiation table failure to which the court shall adjudicate,” said Sossion.
    He said TSC opted for 90 days to conclude negotiations.
    “We chose that the court take over because we had been talking with them for so long, but it never yielded anything,” said Sossion.
    Misori said the Industrial Court Act and Labour Relations rules affirm that no talks of this nature can proceed without cessation of the strike.
    “At this point the TSC, Knut and Kuppet consented to call off strike so that the court takes over,” he said.
    Details from the court revealed that Justice Nderi arrived at the decision to take over the matter after the Government failed to table any offer on a basic salary increase.
    Sources at the meeting said that the two teachers’ unions insisted on the 50 to 60 per cent salary offer made by the TSC last year.
    Knut and Kuppet officials said the offer by the Government prompted them to lower their demand by half, from 300 per cent.
    “The judge pressed TSC to explain why they made an offer which they later withdrew. He then allowed them to consult and return with an offer, but when they returned, they said they did not have one,” said the source.
    Further details also show that TSC had planed to institute contempt proceedings against Sossion.
    “The judge declined that. He also set aside the Musau Ndunda case and squarely dealt with the case presented byTSC,” said Sossion.
    “The judge was warm but also firm and tough. He was smart,” said Sossion.
    In its petition, TSC said that the teachers’ strike is illegal and has paralysed education in public schools.
